
很多制造型企業,因(yin)為市(shi)場需求(qiu),用工需求(qiu)一直都(dou)在變化,為了有效地控制人工成(cheng)本,降低招聘的(de)壓力,不(bu)少企業都(dou)開始聘用非全日制員(yuan)工。
那么企業使用(yong)非全日(ri)制員工,需要注意些什么呢?
根(gen)據(ju)《勞動(dong)合(he)同(tong)(tong)法》第六十(shi)八(ba)條規定,所謂的非全日制(zhi)用(yong)工(gong)是指以小時計酬為主(zhu),勞動(dong)者(zhe)在同(tong)(tong)一用(yong)人單位一般平均(jun)每(mei)日工(gong)作時間不超過(guo)(guo)四小時,每(mei)周工(gong)作時間累計不超過(guo)(guo)二十(shi)四小時的用(yong)工(gong)形式。
常(chang)見(jian)的非全日制用工包括(kuo)實習(xi)、兼職和退休(xiu)返聘。
1、非(fei)全日(ri)制用工可以(yi)不簽訂勞動合同,用人單位可以(yi)口頭(tou)約(yue)定勞動報酬等事項,也不存在雙倍工資的(de)問題;
2、非(fei)全日制(zhi)用工(gong)可以(yi)隨(sui)時(shi)終止用工(gong),不(bu)需(xu)要支付經濟(ji)補(bu)償金,不(bu)存在勞(lao)動(dong)關系,企業(ye)可以(yi)根(gen)據(ju)業(ye)務需(xu)要,靈(ling)活調(diao)整(zheng)用工(gong)人數(shu);
3、非全(quan)日制用工不需要繳納社會保(bao)(bao)險費(fei),用人單位不需要為非全(quan)日制用工的勞動者參加(jia)基本養老保(bao)(bao)險、基本醫療保(bao)(bao)險、生育保(bao)(bao)險和失業(ye)保(bao)(bao)險,只需要為員工參加(jia)工傷保(bao)(bao)險。
按照(zhao)《勞動合(he)同法》第六十(shi)八(ba)條(tiao)規定(ding),工(gong)(gong)資(zi)(zi)分(fen)配所(suo)采取的(de)最基(ji)本的(de)兩種方式是(shi)計(ji)時工(gong)(gong)資(zi)(zi)和計(ji)件工(gong)(gong)資(zi)(zi)。按照(zhao)《勞動保障部關于(yu)(yu)非全日制用(yong)工(gong)(gong)若干問題的(de)意見》規定(ding),非全日制用(yong)工(gong)(gong)小時計(ji)酬(chou)標(biao)準不得(de)低(di)于(yu)(yu)用(yong)人單(dan)位所(suo)在地人民政府規定(ding)的(de)最低(di)小時工(gong)(gong)資(zi)(zi)標(biao)準。
支付周期最長不(bu)得超過十五日(ri),根據(ju)《勞動(dong)合(he)同法》第七十二(er)條第二(er)款,非全日(ri)制用(yong)工(gong)勞動(dong)報酬結算(suan)支付周期最長不(bu)得超過十五日(ri)。
所以企業對于(yu)非全日制用(yong)工(gong)的薪資支付一定(ding)要及時,而且標準也不(bu)是想定(ding)多(duo)(duo)少就定(ding)多(duo)(duo)少。
根據相(xiang)關法(fa)律規定,用(yong)(yong)人單位(wei)支付的小(xiao)時工(gong)資中并未涵蓋(gai)工(gong)傷(shang)保(bao)險(xian)費用(yong)(yong),因此單位(wei)應當及(ji)(ji)時為(wei)建立勞(lao)(lao)動關系的非全(quan)日制(zhi)勞(lao)(lao)動者繳納工(gong)傷(shang)保(bao)險(xian)費,以避免相(xiang)關風險(xian)與(yu)責任(ren)。所以企業(ye)在(zai)使用(yong)(yong)非全(quan)日制(zhi)員工(gong)時,就(jiu)應該及(ji)(ji)時為(wei)員工(gong)購(gou)買工(gong)傷(shang)保(bao)險(xian),一旦(dan)從事(shi)非全(quan)日制(zhi)工(gong)作的勞(lao)(lao)動者發生工(gong)傷(shang),依法(fa)享受工(gong)傷(shang)保(bao)險(xian)待遇(yu)。
應當(dang)參加(jia)工(gong)傷(shang)(shang)保(bao)(bao)(bao)險(xian)而未參加(jia)或者未按(an)規(gui)定繳納(na)工(gong)傷(shang)(shang)保(bao)(bao)(bao)險(xian)費(fei)的(de)用人(ren)單位,未參加(jia)工(gong)傷(shang)(shang)保(bao)(bao)(bao)險(xian)或者未按(an)規(gui)定繳納(na)工(gong)傷(shang)(shang)保(bao)(bao)(bao)險(xian)費(fei)期間,從業人(ren)員發生(sheng)工(gong)傷(shang)(shang)的(de),由用人(ren)單位按(an)照(zhao)規(gui)定的(de)工(gong)傷(shang)(shang)保(bao)(bao)(bao)險(xian)待遇項目(mu)和(he)標準(zhun)支付費(fei)用。如用人(ren)單位參加(jia)工(gong)傷(shang)(shang)保(bao)(bao)(bao)險(xian)并(bing)補繳應當(dang)繳納(na)的(de)工(gong)傷(shang)(shang)保(bao)(bao)(bao)險(xian)費(fei)、滯(zhi)納(na)金(jin)后,由工(gong)傷(shang)(shang)保(bao)(bao)(bao)險(xian)基(ji)金(jin)和(he)用人(ren)單位依照(zhao)規(gui)定支付新發生(sheng)的(de)費(fei)用。
因當地政策致使(shi)單(dan)(dan)位(wei)無(wu)法(fa)為非全(quan)日制(zhi)員(yuan)工單(dan)(dan)獨(du)繳納工傷(shang)保險(xian)(xian)費的,企業(ye)可考(kao)慮購(gou)買(mai)雇主(zhu)責任險(xian)(xian)等(deng)商業(ye)險(xian)(xian)種(zhong)以分擔用人風險(xian)(xian)。
非全(quan)日(ri)制用(yong)工的(de)(de)(de)工作(zuo)時(shi)(shi)間一般為每(mei)(mei)(mei)天四(si)小(xiao)時(shi)(shi),每(mei)(mei)(mei)周(zhou)工作(zuo)時(shi)(shi)間不(bu)超過(guo)二十四(si)小(xiao)時(shi)(shi),這(zhe)與全(quan)日(ri)制用(yong)工實行每(mei)(mei)(mei)天工作(zuo)不(bu)超過(guo)八小(xiao)時(shi)(shi),每(mei)(mei)(mei)周(zhou)不(bu)超過(guo)四(si)十小(xiao)時(shi)(shi)的(de)(de)(de)工時(shi)(shi)制度是不(bu)同的(de)(de)(de),因(yin)此(ci),非全(quan)日(ri)制用(yong)工的(de)(de)(de)工作(zuo)時(shi)(shi)間必須符合法定(ding)的(de)(de)(de)要求,用(yong)人單位(wei)對此(ci)要承(cheng)擔舉證責任(ren),否則有被認定(ding)為全(quan)日(ri)制用(yong)工的(de)(de)(de)風(feng)險。
非(fei)全日制用工雖然優勢很(hen)明顯,在未來也將被更多(duo)企業采用,但涉及到(dao)的用工風險還是要及時防范,切勿因小失大。
