員工發生工傷的賠付流程和標準是什么?特殊情況怎么處理?

對(dui)于工傷(shang)事故處理,HR一直都(dou)是非常小心謹慎的(de),因為(wei)不僅(jin)涉及(ji)到認定、賠償,還(huan)有后續的(de)很多事項,想要(yao)妥(tuo)善(shan)處理好相關的(de)工傷(shang)事宜(yi),就必須對(dui)規則和(he)流程十分清楚。


那(nei)么(me),員(yuan)工發生工傷事(shi)故后,HR第一步(bu)要做(zuo)的是(shi)什么(me)呢?有哪些(xie)事(shi)項和(he)標準是(shi)需(xu)要特別注意的呢?


一、工傷賠付的流程

第一步:認定申請

根據《工(gong)(gong)傷(shang)保(bao)(bao)險條(tiao)例》、《工(gong)(gong)傷(shang)認(ren)定(ding)辦(ban)法(fa)》的規定(ding),職工(gong)(gong)發(fa)(fa)生(sheng)事故傷(shang)害或(huo)者按照職業(ye)病防治法(fa)規定(ding)被(bei)診斷(duan)、鑒(jian)定(ding)為(wei)職業(ye)病,所在單位(wei)應當自事故傷(shang)害發(fa)(fa)生(sheng)之(zhi)日或(huo)者被(bei)診斷(duan)、鑒(jian)定(ding)為(wei)職業(ye)病之(zhi)日起30日內(nei),向統籌地區社(she)(she)會(hui)保(bao)(bao)險行(xing)政部門提出工(gong)(gong)傷(shang)認(ren)定(ding)申(shen)請。遇有(you)(you)特殊情況,經報社(she)(she)會(hui)保(bao)(bao)險行(xing)政部門同(tong)意,申(shen)請時限可以適當延長,如果用(yong)人單位(wei)沒(mei)有(you)(you)在上(shang)述(shu)時間內(nei)提交工(gong)(gong)傷(shang)認(ren)定(ding)申(shen)請,在此期(qi)間發(fa)(fa)生(sheng)的工(gong)(gong)傷(shang)待遇等有(you)(you)關費用(yong)則由該(gai)用(yong)人單位(wei)負擔。


第二步:工傷鑒定

社會(hui)(hui)保(bao)險行政(zheng)部(bu)門(men)應當自受(shou)理(li)工(gong)(gong)(gong)傷(shang)(shang)認(ren)(ren)定(ding)(ding)(ding)(ding)申請(qing)之(zhi)日(ri)(ri)起60日(ri)(ri)內作(zuo)出(chu)(chu)工(gong)(gong)(gong)傷(shang)(shang)認(ren)(ren)定(ding)(ding)(ding)(ding)決(jue)定(ding)(ding)(ding)(ding),出(chu)(chu)具《認(ren)(ren)定(ding)(ding)(ding)(ding)工(gong)(gong)(gong)傷(shang)(shang)決(jue)定(ding)(ding)(ding)(ding)書》或者《不予認(ren)(ren)定(ding)(ding)(ding)(ding)工(gong)(gong)(gong)傷(shang)(shang)決(jue)定(ding)(ding)(ding)(ding)書》。社會(hui)(hui)保(bao)險行政(zheng)部(bu)門(men)對于事實清楚、權利義(yi)務明(ming)確的工(gong)(gong)(gong)傷(shang)(shang)認(ren)(ren)定(ding)(ding)(ding)(ding)申請(qing),應當自受(shou)理(li)工(gong)(gong)(gong)傷(shang)(shang)認(ren)(ren)定(ding)(ding)(ding)(ding)申請(qing)之(zhi)日(ri)(ri)起15日(ri)(ri)內作(zuo)出(chu)(chu)工(gong)(gong)(gong)傷(shang)(shang)認(ren)(ren)定(ding)(ding)(ding)(ding)決(jue)定(ding)(ding)(ding)(ding)。社會(hui)(hui)保(bao)險行政(zheng)部(bu)門(men)應當自工(gong)(gong)(gong)傷(shang)(shang)認(ren)(ren)定(ding)(ding)(ding)(ding)決(jue)定(ding)(ding)(ding)(ding)作(zuo)出(chu)(chu)之(zhi)日(ri)(ri)起20日(ri)(ri)內,將《認(ren)(ren)定(ding)(ding)(ding)(ding)工(gong)(gong)(gong)傷(shang)(shang)決(jue)定(ding)(ding)(ding)(ding)書》或者《不予認(ren)(ren)定(ding)(ding)(ding)(ding)工(gong)(gong)(gong)傷(shang)(shang)決(jue)定(ding)(ding)(ding)(ding)書》送達(da)受(shou)傷(shang)(shang)害職工(gong)(gong)(gong)(或者其近(jin)親屬)和用人單位(wei),并抄送社會(hui)(hui)保(bao)險經辦機構。


第三步:工傷賠償

工(gong)(gong)(gong)(gong)傷(shang)(shang)(shang)(shang)認定及傷(shang)(shang)(shang)(shang)殘鑒(jian)定完(wan)成后,就需要根據最(zui)新的(de)工(gong)(gong)(gong)(gong)傷(shang)(shang)(shang)(shang)賠(pei)償(chang)(chang)標準,根據每個受(shou)傷(shang)(shang)(shang)(shang)員工(gong)(gong)(gong)(gong)的(de)勞(lao)動能(neng)力喪失程度(du)及護(hu)理依(yi)賴程度(du)不同(tong),傷(shang)(shang)(shang)(shang)殘等級(ji)分為一(yi)至(zhi)十個等級(ji),最(zui)低等級(ji)是(shi)十級(ji),從(cong)低到高,依(yi)次(ci)(ci)(ci)遞增(zeng)。具體(ti)可參照《工(gong)(gong)(gong)(gong)傷(shang)(shang)(shang)(shang)保險條例》中(zhong)關(guan)于工(gong)(gong)(gong)(gong)傷(shang)(shang)(shang)(shang)保險待遇的(de)規定計(ji)算其賠(pei)償(chang)(chang)費(fei)(fei)用。即(ji)(ji)使是(shi)被評(ping)定為最(zui)低等級(ji)十級(ji)的(de)受(shou)傷(shang)(shang)(shang)(shang)員工(gong)(gong)(gong)(gong),也包含護(hu)理費(fei)(fei)、醫療(liao)費(fei)(fei)、停工(gong)(gong)(gong)(gong)留(liu)薪(xin)期(qi)工(gong)(gong)(gong)(gong)資(即(ji)(ji)誤(wu)工(gong)(gong)(gong)(gong)費(fei)(fei))、交(jiao)通費(fei)(fei)、一(yi)次(ci)(ci)(ci)性殘疾補助(zhu)金、一(yi)次(ci)(ci)(ci)性工(gong)(gong)(gong)(gong)傷(shang)(shang)(shang)(shang)醫療(liao)補助(zhu)金等賠(pei)償(chang)(chang)款項。


二、工傷待遇計算標準

基于《工傷保(bao)險條例(li)》相關(guan)規定及最新統計數據歸納總結,供參考:


(一)1-10級一次性傷殘補助金

依據《工(gong)傷(shang)保險條例》第三十五條、第三十六條、第三十七條規定,職工(gong)因工(gong)致(zhi)殘(can)被鑒(jian)定為一(yi)(yi)級至十級傷(shang)殘(can)的,由(you)工(gong)傷(shang)保險基金支付一(yi)(yi)次(ci)性傷(shang)殘(can)補助金,標準如下:


一級傷殘本人工資×27個月
二級傷殘本人工資×25個月
三級傷殘本人工資×23個月
四級傷殘本人工資×21個月
五級傷殘本人工資×18個月
六級傷殘本人工資×16個月
七級傷殘本人工資×13個月
八級傷殘本人工資×11個月
九級傷殘本人工資×9個月
十級傷殘本人工資×7個月


本人(ren)工(gong)(gong)(gong)(gong)資:是指工(gong)(gong)(gong)(gong)傷職(zhi)工(gong)(gong)(gong)(gong)因(yin)工(gong)(gong)(gong)(gong)作(zuo)遭受事故傷害或者患職(zhi)業病前(qian)12個月平均(jun)月繳費工(gong)(gong)(gong)(gong)資。本人(ren)工(gong)(gong)(gong)(gong)資高于(yu)統(tong)(tong)籌(chou)地(di)(di)區職(zhi)工(gong)(gong)(gong)(gong)平均(jun)工(gong)(gong)(gong)(gong)資300%的,按照統(tong)(tong)籌(chou)地(di)(di)區職(zhi)工(gong)(gong)(gong)(gong)平均(jun)工(gong)(gong)(gong)(gong)資的300%計算(suan);本人(ren)工(gong)(gong)(gong)(gong)資低于(yu)統(tong)(tong)籌(chou)地(di)(di)區職(zhi)工(gong)(gong)(gong)(gong)平均(jun)工(gong)(gong)(gong)(gong)資60%的,按照統(tong)(tong)籌(chou)地(di)(di)區職(zhi)工(gong)(gong)(gong)(gong)平均(jun)工(gong)(gong)(gong)(gong)資的60%計算(suan)(下同)。


(二)1-6級傷殘津貼(按月享受)

依據《工(gong)(gong)傷保險條例》第三十(shi)(shi)五條、第三十(shi)(shi)六(liu)條規(gui)定,職工(gong)(gong)因工(gong)(gong)致殘被鑒定為(wei)一級至六(liu)級傷殘的,按月支付傷殘津貼,標準如下:


一級傷殘本人工資×90%
二級傷殘本人工資×85%
三級傷殘本人工資×80%
四級傷殘本人工資×75%
五級傷殘本人工資×70%
六級傷殘本人工資×60%


特別說明:

1、1-4級傷(shang)殘津貼由(you)工傷(shang)保險基金支付,實際金額低(di)(di)于當(dang)地最低(di)(di)工資標(biao)準的,由(you)工傷(shang)保險基金補足(zu)差額;

2、5-6級傷殘(can)津貼(tie)由(you)用人單位在(zai)難以(yi)安排工作的(de)(de)情況下支付(fu),傷殘(can)津貼(tie)實際金額低(di)于(yu)當地最低(di)工資標準的(de)(de),由(you)用人單位補足差額。


(三)5-10級一次性工傷醫療補助金和傷殘就業補助金

1、一次性工(gong)傷醫(yi)療(liao)補助金(jin):由工(gong)傷保險(xian)基金(jin)支付;

2、一次性傷殘(can)就業補助金:由用(yong)人單位(wei)支付。


上述兩金標準,根(gen)據傷(shang)殘(can)等(deng)級確定,《工(gong)傷(shang)保險條例(li)》未規(gui)定統(tong)一(yi)標準,具體標準授權(quan)各省、自治區、直(zhi)轄市人(ren)民政府規(gui)定,一(yi)般是按照本人(ren)工(gong)資一(yi)定倍數(shu)計算(suan)。可(ke)以在各省的工(gong)傷(shang)保險條例(li)或工(gong)傷(shang)保險辦法中查閱。


三、特殊情況處理

1.職工在兩個用人單位同時就業的,其發生工傷后,由哪個單位依法承擔工傷保險責任?

根據《實(shi)施〈中(zhong)華人民共和(he)國社會保(bao)險法(fa)〉若(ruo)干規(gui)定(ding)》第九條(tiao)規(gui)定(ding),職工(gong)(gong)(gong)在兩個(ge)或(huo)者兩個(ge)以(yi)上用人單位(wei)同時就業(ye)的,各用人單位(wei)應當依(yi)法(fa)分別為職工(gong)(gong)(gong)繳納工(gong)(gong)(gong)傷(shang)(shang)保(bao)險費。職工(gong)(gong)(gong)發(fa)生(sheng)工(gong)(gong)(gong)傷(shang)(shang),由職工(gong)(gong)(gong)受到傷(shang)(shang)害(hai)時工(gong)(gong)(gong)作的單位(wei)依(yi)法(fa)承擔工(gong)(gong)(gong)傷(shang)(shang)保(bao)險責任。


2.一次性工亡補助金標準是多少?

根據《工傷保險條例(li)》第(di)三十(shi)九條規定(ding),一(yi)次性工亡補助金標準為(wei)上(shang)一(yi)年度全國城(cheng)鎮居民人均(jun)可支配(pei)收入的20倍。


3.一般情況下停工留薪期最長時間為多少?

根據(ju)《工傷保險(xian)條例》第(di)三十三條規(gui)定(ding),停工留薪(xin)期一般不超(chao)過12個月。傷情嚴(yan)重或者(zhe)情況(kuang)特殊,經設(she)區的市(shi)級(ji)勞動能力鑒定(ding)委(wei)員會確認,可以適當延長(chang),但延長(chang)不得超(chao)過12個月。


4.治療工傷所需的醫療費用應由誰支付?

根(gen)據《工傷(shang)保(bao)險(xian)(xian)條例(li)》第三十條規定(ding),治療(liao)工傷(shang)所(suo)需費用符合工傷(shang)保(bao)險(xian)(xian)診療(liao)項(xiang)目(mu)(mu)目(mu)(mu)錄、工傷(shang)保(bao)險(xian)(xian)藥品目(mu)(mu)錄、工傷(shang)保(bao)險(xian)(xian)住院服務標準的,從(cong)工傷(shang)保(bao)險(xian)(xian)基金(jin)支付。


5.生活不能自理的工傷職工在停工留薪期需要護理的,由誰來負責?

根據《工傷保險條例(li)》第三十三條規定,生活不能自理的(de)工傷職工在(zai)停(ting)工留薪期需要護理的(de),由所在(zai)單位負責。


6.用人單位分立、合并、轉讓的,由誰來承擔原用人單位的工傷保險責任?

根據《工(gong)(gong)傷(shang)保(bao)(bao)險(xian)(xian)條(tiao)例》第四(si)十三條(tiao)第一款規定(ding),用人單位分立、合并、轉讓(rang)的,承繼(ji)單位應當承擔原用人單位的工(gong)(gong)傷(shang)保(bao)(bao)險(xian)(xian)責任;原用人單位已經參加工(gong)(gong)傷(shang)保(bao)(bao)險(xian)(xian)的,承繼(ji)單位應當到當地經辦機構辦理工(gong)(gong)傷(shang)保(bao)(bao)險(xian)(xian)變(bian)更(geng)登記。


7.職工再次發生工傷,應當如何處理?

根(gen)據(ju)《工(gong)傷(shang)保險條例(li)》第(di)四十五條規(gui)定(ding),職工(gong)再次發生工(gong)傷(shang),根(gen)據(ju)規(gui)定(ding)應當享受傷(shang)殘津貼(tie)的(de)(de),按照新(xin)認(ren)定(ding)的(de)(de)傷(shang)殘等級享受傷(shang)殘津貼(tie)待遇(yu)。


對工傷問題的(de)處(chu)理(li),預防(fang)始終(zhong)是(shi)重點,所以在(zai)平時(shi)的(de)管理(li)中,安全事(shi)項也(ye)是(shi)要特別強調和注意(yi)的(de)。
